I just want to get back to the John Birmingham article and GD’s comments earlier today, to clear up something.
We all like to believe that the Greens voted down the Malaysian Solution in the Senate, in collusion with the then opposition. I’ve probably said that at same time, so have most of us.
But we were all wrong. The more you study the more you learn.
The Malaysian Solution was never dependent on legislation, and it was never debated in the Senate.
Here’s what happened.
On 7 May 2011 Julia Gillard, announced she had reached an agreement with the government of Malaysia, in which they would take 800 of our boat arrivals and in return Australia would resettle 4000 refugees then stuck in Malaysia. This was done not through any legislation, but through then Immigration Minister Chris Bowen using his ministerial powers to make a declaration. This avoided any embarrassing losses of divisions in parliament.
The move was challenged in the High Court and the court ruled against it on 31 August 2011. Not only did that decision destroy the Malaysian Solution, it also put into doubt the legality of all offshore detention.
Before that judgement had been handed down Julia Gillard had finalised an agreement with the PNG government to re-open the detention centre on Manus Island as an ‘assessment centre’, to be part of the Malaysian deal.
In response to the High Court the Gillard government came up with a new bill, the Migration Legislation Amendment (Regional Processing and Other Measures) Bill 2011 This bill was introduced on 22 September 2011 and briefly debated in the Reps but was abandoned when it became clear it was not going to be passed.
Other things happened. Some asylum seekers were brought to the mainland from Christmas Island and given bridging visas and allowed to live in the community. An inquiry into the management of asylum seekers was held.
The Gillard government and the Labor Party remained committed to some form of off-shore processing.
In June 2012 Julia Gillard announced the formation of the Expert Panel on Asylum Seekers, the panel handed down their report on 13 August 2012. The Gillard government accepted all the proposals in that report. One of the first to be adopted was the resumption of off-shore processing.
To allow off-shore processing to go ahead and to address the concerns of the High Court the Migration Legislation Amendment (Regional Processing and Other Measures) Bill 2012 was returned to parliament for debate. All the details of that bill and the debate can be accessed here –

The bill passed the Reps. The Senate debate was long and emotional, and the Greens tried to get many amendments and failed on all of them. In the end the bill passed with only the Greens opposing it.

So there you go – the Greens never did vote down the Malaysian Solution because they never had a chance to do that. It was the High Court that killed that plan.
Just a bit more – what the Greens did do was move motions in both houses condemning the Malaysian Solution. It was a pointless exercise, it didn’t achieve anything but a bit of ‘Labor defeated in both houses’ media coverage. The motions, presented in the Senate on 11 May 2011 by Sarah Hanson-Young, seconded by Michaelia Cash, and in the Reps on 16 June 2011 by Adam Bandt, seconded by Andrew Wilkie, just called on the Gillard government to abandon the Malaysian Solution and were passed by both houses. The motions were purely attention seeking, supported by the opposition, the sort of thing oppositions and minor parties do when they want to make their feelings clear but have no way of stopping a government decision.
Then the High Court killed the whole idea anyway.

I’d say that ‘threat’ came straight from National Party campaign headquarters, as a stunt to get voters to believe anyone against mining is a violent lout.
Remember, most of Barnaby’s competition this election, at least, the competition likely to attract disgruntled National voters, comes from candidates who are against mining and fracking, and especially against mining on the Liverpool Plains, something Barnaby seems to favour. Internal polling has probably shown he will lose votes to some of these candidates, so to be on the safe side the Nats cooked up a little stunt.That stunt allowed Barnaby to have a good rant about greenies, environmentalists and the Queensland government.
Far-fetched? Not really. I’ve seen first hand some of the dirty tricks the Nats like to use in election campaigns. This one is right up their alley.

Let’s demolish that argument – it’s not hard to do. One little thing shoots it to pieces – the Law of Return says if a Jew has voluntarily changed his/her religion they are no longer considered a Jew and cannot return to Israel under the Law of Return provisions. To use Jennifer’s own link –

Obviously she just read a couple of sentences, leapt to a conclusion (the wrong one) and didn’t bother reading any further.
For someone to claim Israeli citizenship under the Law of Return they first have to migrate to Israel – something else in that link Ms Wilson forgot to read. I don’t think Turnbull has any intention of moving to Israel. If he did want to do that and wanted to claim Israeli citizenship he’d have to convert to Judaiism first.
Turnbull was never Jewish anyway, he was raised Presbyterian, to a family with a long tradition of following that faith, and changed to Catholicism for Lucy. His maternal grandmother may have been Jewish, but that faith certainly didn’t carry on to Turnbull. I suspect that claim was just one of those things Turnbull says to curry favour.

Get ready for a March election. Federal parliament is now on course for a verdict from voters early in the new year to make or break the Turnbull government.
This does not mean a general election. Instead, the parliament faces a series of by-elections that are likely to be held on the same day for the same reason: a High Court decision that disqualifies a new batch of politicians.
March 24 is a clear option but the timing could stretch into April or beyond, since the date and scale of this “mini-election” is almost entirely in the hands of the court.
In theory, there may be no by-elections at all. In practice, there is a strong case for several MPs to be referred to the High Court and there is an obvious prospect that some will be disqualified and forced to the ballot box.
This will be very different to a standard by-election, where Australians know they can give the government a belting without bringing the government undone.
The stakes will be higher and the campaign will be national. In a plausible scenario, voters will be casting their verdicts on MPs in several states and in electorates that range from cities to the regions. Votes will be cast in the full knowledge they will decide who governs the country.
Talk of a general election, an idea suggested by independent Andrew Wilkie if more than two or three MPs are disqualified, is overblown. There are no grounds for the governor-general to dissolve the House of Representatives. The by-elections must come first.
If Andrew Wilkie really did suggest a general election early next year then he’s a much bigger idiot than I thought.
If a general election was called for early next year it would have to be either an election just for the House of Representatives or a double dissolution, because of the rules about senate terms. (I’ve said this so often I sound like a cracked record.)
A Reps-only election would see us all going back to the polling booths about a year later, to elect a new half-Senate.
That’s another reason why Turnbull won’t go to a general election.
